Terms of Sale and Website Use
1. The seller
The seller is Nadasi Technologies Kft., a company registered in Hungary, trading as WickedErgonomy. References to “the seller” in these terms are to that company.

2. Eligibility
Purchase is restricted to persons aged 18 or over, or the local age of majority where that is higher. The purchaser is responsible for establishing that possession of these products is lawful in their jurisdiction.
These terms apply to consumer sales. Purchasers acting in the course of a business must notify the seller before ordering; certain rights below apply to consumers only.
3. The products
The seller designs and manufactures rigid physical restraints for adults, made to order in Hungary and supplied across the EU and beyond.
Two characteristics form part of this contract:
- The products are designed to hold securely. They cannot be relied upon to yield under force or in an emergency, and no product detects that a restrained person is in difficulty.
- The products are not safety equipment, medical devices, or protective equipment, and no such claim is made.
The Safety Guidelines should be read before ordering, including the section governing the intended mode of use. Confirmation of this is required at checkout.
4. Formation of contract
An order constitutes an offer to purchase. The contract is formed when the seller issues an order confirmation, not on submission of the order and not on payment.
The seller may decline an order, including after payment, where the item cannot be manufactured to the measurements supplied, where there is reason to believe the purchaser is under 18, where delivery to the destination is not lawfully or practically possible, or where an intended use is described that the seller considers unsafe. A declined order is refunded in full.
A working email address is required. Order confirmations, dispatch notices, any notice under clause 7, and all correspondence are sent to it.
5. Prices and taxes
Prices are stated in euro and include VAT. The price displayed is the price payable at any destination: for EU destinations the applicable VAT is calculated from that total, and orders outside the EU are zero-rated exports at the same price.
Customs duties and import taxes outside the EU are excluded and are payable by the purchaser. The seller cannot calculate them in advance.
Prices may change, but not for a confirmed order.
6. Items made to measure
Most items are manufactured to dimensions supplied by the purchaser.
The purchaser is responsible for the accuracy of those dimensions and for taking them as described in the Measurement Guidelines.
As goods made to the consumer’s specification, the 14-day right of withdrawal does not apply to such items. Clause 8 sets out what does apply. Rights arising where an item is faulty or not as described are unaffected.
7. Manufacture and delivery
Orders are dispatched within 20 days. Transit time is additional and varies by destination; estimates appear in Shipping, Returns and Refunds.
Where dispatch within 20 days is not possible, the seller will give notice before that date, stating the reason, a revised date where known, and offering cancellation with a full refund. No reason need be given for cancelling.
Risk passes on delivery to the purchaser or to a person nominated by the purchaser.
Goods are dispatched in plain, unbranded packaging bearing no indication of contents.
8. Cancellation, return and refund
Set out in full in Shipping, Returns and Refunds, which forms part of these terms. In summary:
- Standard-size items: the 14-day right of withdrawal applies.
- Items made to measure: the right of withdrawal does not apply, as goods made to the consumer’s specification.
- Faulty, damaged or misdescribed items: statutory rights apply to all items supplied, and are not limited by these terms.
9. Defective or misdescribed goods
Statutory rights under EU and Hungarian consumer law apply where goods are not as described, not of satisfactory quality, or not fit for purpose. Those rights apply irrespective of these terms and are not reduced by them.
Claims should be sent to info@wickedergonomy.com with the order number. Photographs assist resolution and may be requested before a return is arranged.
10. After-sales support and guarantees
Statutory rights under clause 9 are unaffected by this clause.
In addition:
- The seller answers enquiries concerning fit, use, care and condition for as long as a product remains in manufacture.
- Faults attributable to the seller are repaired or replaced at the seller’s cost, as clause 9 provides.
- No separate commercial guarantee or extended warranty is offered.
- Spare parts and repairs outside the fault period are quoted individually at the cost of materials and time. This is a discretionary service and not a contractual entitlement.
11. Permitted use
The purchaser undertakes that:
- all persons using the product will be aged 18 or over and will consent;
- the product will not be used on any person who has not consented, on any person unable to consent, or to threaten, coerce or intimidate;
- the product will be kept inaccessible to minors and to non-consenting persons;
- the published safety information will be followed, and the product will not be modified or combined with equipment for which it was not designed.
Use of a restraint on a person without consent is a serious criminal offence in every country to which these products are sold. The seller cooperates fully with any lawful investigation.
12. Liability
The seller is liable for foreseeable loss or damage arising from breach of this contract or from failure to exercise reasonable care and skill.
Nothing in these terms excludes or limits liability where exclusion or limitation would be unlawful. This includes liability for death or personal injury caused by negligence, for fraud, for defective products under product-liability law, and for any statutory right that cannot lawfully be waived.
Subject to the above, the seller is not liable for:
- the manner in which a product is used, the persons permitted to use it, or the circumstances of use, all of which are determined by the purchaser;
- loss that was not foreseeable at the time the contract was formed;
- business losses, these products being supplied for private use.
The acknowledgements given at checkout and this clause operate independently; neither limits the other.
13. Data protection
Personal data is handled as described in the Privacy Policy, which includes the records retained of confirmations given at checkout and the periods for which they are held.
14. The website
The seller does not warrant that the website will be uninterrupted or error-free, and may alter or withdraw parts of it.
Product images are representative. Colour reproduction varies between displays, and made-to-order items vary between examples.
Website content is the property of the seller and may not be reproduced commercially without permission.
Suggestions submitted to the seller may be used without obligation or compensation.
15. Amendment
These terms may be amended. The version applicable to an order is the version published when that order was placed, and previous versions are retained. Amendments do not apply retrospectively to confirmed orders.
16. Governing law and disputes
These terms are governed by Hungarian law.
This does not deprive a consumer of the protection of mandatory provisions of the law of their country of residence. EU consumers retain those rights and may bring proceedings in their own jurisdiction.
Complaints should be addressed to the seller in the first instance. The Impressum names the competent consumer-protection authority and arbitration board.
